App2Food — Customer Terms of Service

These Customer Terms of Service ("Terms") govern your use of the App2Food platform as a customer placing food orders.

App2Food is operated by App2Mobile, LLC d/b/a App2Food ("App2Food," "we," "us," or "our"). By using the Platform — whether through our website, mobile application, or kiosk — you agree to be bound by these Terms. If you do not agree, please do not use the Platform.


1. DEFINITIONS

"Platform" means the App2Food website, mobile application, kiosk ordering system, and all associated ordering and payment tools.

"Restaurant Partner" means any restaurant, food service business, or other food vendor that has registered with App2Food to offer ordering through the Platform.

"Order" means any food or non-alcoholic beverage purchase you place through the Platform at a Restaurant Partner.

"Guest Checkout" means the option to place an Order without creating a registered account.

"Loyalty Program" means the optional points-based rewards program available to registered account holders at participating Restaurant Partners.

"Gift Card" means a digital prepaid instrument issued through the Platform that can be used toward purchases at participating Restaurant Partners.

"Square" means Square, Inc., App2Food's payment processing partner.

"DoorDash" means DoorDash, Inc., App2Food's third-party delivery partner.


2. ACCEPTANCE OF TERMS

By placing an Order through the Platform — whether as a registered account holder or as a guest — you confirm that you have read these Terms and agree to be bound by them. If you are using the Platform on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.


3. ELIGIBILITY

You must be at least 13 years of age to use the Platform. If you are between 13 and 18 years of age, you may only use the Platform with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the Platform, you represent that you meet these age requirements.

App2Food does not currently permit the sale or ordering of alcoholic beverages or other age-restricted items through the Platform. See Section 11 for additional terms.


4. ACCOUNTS AND GUEST CHECKOUT
4.1 Registered Accounts

You may create a registered account to access additional features including order history, loyalty points, saved payment methods, and one-click reordering.

4.2 Guest Checkout

You may place Orders without creating an account using Guest Checkout. Guest Checkout orders are not eligible for loyalty points or access to order history.

4.3 Account Security

You agree to notify App2Food immediately at support@app2food.com if you become aware of any unauthorized use of your account or any other security breach.

4.4 Account Termination

App2Food reserves the right to suspend or terminate your account at any time if you violate these Terms.


5. PLACING ORDERS
5.1 Order Accuracy

You are responsible for reviewing your Order carefully before submission, including selected items, customizations, quantities, pickup or delivery address, and scheduled time.

5.2 Order Confirmation

Upon placing an Order, you will receive a confirmation via email or SMS.

5.3 Order Modifications and Cancellations

Once an Order is submitted and accepted by the Restaurant Partner, modifications and cancellations may not be possible.

5.4 Menu Accuracy

Menu items, descriptions, pricing, and availability are set and maintained by each Restaurant Partner.

5.5 Scheduled Orders

The Platform supports advance scheduling of Orders. Estimated pickup and delivery times are not guaranteed.


6. PAYMENT
  • Accepted payment methods include Visa, Mastercard, American Express, and Discover.
  • All payments are securely processed through Square.
  • A convenience fee may be charged on each Order.
  • Delivery fees may apply through DoorDash.
  • Applicable sales taxes will be collected where required by law.
  • Pricing errors may result in Order cancellation and refund.

7. REFUNDS AND CANCELLATIONS
  • Refunds are subject to the Restaurant Partner's refund policy.
  • App2Food may facilitate refunds, credits, or adjustments where appropriate.
  • Cancellation charges may apply after Order acceptance.
  • Convenience fees and delivery fees are generally non-refundable.
  • Gift Card purchases are non-refundable.

8. DELIVERY
  • Delivery services are facilitated through DoorDash.
  • Delivery availability depends on operational conditions and coverage areas.
  • You are responsible for providing an accurate delivery address.
  • Delivery issues should be reported to support@app2food.com.

9. LOYALTY PROGRAM
  • The Loyalty Program is available to registered account holders.
  • Points are earned on eligible Orders.
  • Points may be redeemed for discounts or rewards.
  • Points expire after 12 months of inactivity.
  • Fraudulent use may result in account suspension.

10. GIFT CARDS
  • Digital Gift Cards may be purchased and redeemed on the Platform.
  • Gift Cards have no cash value unless required by law.
  • Gift Cards do not expire unless required by state law.
  • App2Food is not responsible for lost or stolen Gift Cards.

11. AGE-RESTRICTED ITEMS

App2Food does not currently permit the sale, ordering, pickup, or delivery of alcoholic beverages, tobacco, nicotine products, cannabis products, or any other age-restricted items through the Platform.


12. PROHIBITED CONDUCT
  • Place fraudulent or abusive Orders;
  • Manipulate Loyalty Programs;
  • Impersonate any person or entity;
  • Submit false reviews;
  • Attempt unauthorized access;
  • Use the Platform unlawfully.

13. INTELLECTUAL PROPERTY

All content on the Platform is the property of App2Food or its licensors.


14. USER-GENERATED CONTENT

By submitting reviews, photos, or other content, you grant App2Food a non-exclusive, royalty-free, worldwide license to use such content.


15. DATA PRIVACY
  • We collect personal information to process Orders and improve services.
  • We share information with Square, DoorDash, and Restaurant Partners.
  • We do not sell personal information for marketing purposes.
  • We use cookies and tracking technologies including Meta Pixel and Google Tag Manager.
  • You may request deletion of your personal data.

16. CHILDREN'S PRIVACY

The Platform is not directed to children under 13 years of age.


17. THIRD-PARTY LINKS AND SERVICES

The Platform may contain links to third-party services including Square and DoorDash.


18. DISCLAIMER OF WARRANTIES

THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.


19. LIMITATION OF LIABILITY

APP2FOOD SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.


20. INDEMNIFICATION

You agree to indemnify and hold harmless App2Food and its affiliates from claims arising from your use of the Platform.


21. FORCE MAJEURE

App2Food shall not be liable for delays or failures caused by circumstances beyond reasonable control.


22. DISPUTE RESOLUTION AND ARBITRATION
  • Disputes should first be addressed informally through support@app2food.com.
  • Unresolved disputes shall be submitted to binding arbitration.
  • Class action lawsuits are waived.
  • You waive the right to a jury trial.

23. GOVERNING LAW

These Terms are governed by the laws of the State of New Jersey.


24. MODIFICATIONS TO TERMS

App2Food reserves the right to update these Terms at any time.


25. GENERAL PROVISIONS
  • These Terms constitute the entire agreement between you and App2Food.
  • If any provision is unenforceable, the remaining provisions remain effective.
  • Failure to enforce any provision does not waive future enforcement rights.
